Overview of the important stuff

Here’s what you need to know:

  • DenZen is a rent forgiveness program offered through your property management company and/or landlord. DenZen is not an insurance policy to you.

  • If you lose your job (through no fault of your own), you can submit a rent forgiveness request to us. We'll work with your property manager to forgive up to three months of rent, depending on your coverage.

  • The full program details (what's covered, what's excluded, and how requests are processed) are outlined in your Lease Addendum. This page covers the legal terms of working with DenZen.

  • Questions? Email [email protected] and we’ll get back to you as soon as we can.

1. Definitions of words used

When you see these terms, here's what they mean:

  • “You" and "your" mean the resident enrolled in the DenZen rent forgiveness program through your lease.

  • "DenZen," "we," "us," and "our" mean DenZen, Inc., the company that administers the rent forgiveness program.

  • "Property Partner" means your property management company, Brandywine Homes. They're the party who has agreed to forgive your rent under your Lease Addendum.

  • "Lease Addendum" means the DenZen Rent Forgiveness Program addendum attached to your lease agreement. It contains the full program terms, including eligibility, coverage amounts, exclusions, and timelines.

  • "Rent Forgiveness Request" means a request you submit to DenZen asking to have your rent forgiven under the program.

2. What DenZen is (and isn’t)

DenZen is a rent forgiveness program. We are not an insurance company, and DenZen is not an insurance policy.

DenZen acts as the designated representative for your Property Partner. That means we handle your enrollment, review your Rent Forgiveness Request, and if it’s approved, we coordinate paying rent on your behalf to your Property Partner. Your rent is forgiven by your Property Partner under the terms of your Lease Addendum.

3. How a Rent Forgiveness Request works

The full process, timelines, and required documentation are described in your Lease Addendum.

Here's what to generally expect:

  1. You submit a Rent Forgiveness Request to DenZen as soon as reasonably possible after you lose your job, and no later than 30 days after job loss.

  2. You provide proof of job loss (like your offboarding letter from HR or your separation agreement from your employer, or some other types of documentation we’ll ask you for) within 90 days after you lose your job.

    1. We review your request and communicate a decision within 14 days of receiving your request and any related documentation.

  3. If approved, your rent is forgiven for the covered months and we pay your Property Partner directly. We’ll communicate status updates and you'll receive written confirmation for each approved month your rent is forgiven.

What you need to show us

When you submit a request, it's your responsibility to give us enough documentation to confirm two things:

  1. Your situation falls under one of the covered reasons listed in your Lease Addendum.

  2. Your situation is not one of the excluded reasons listed in your Lease Addendum.

If we can't confirm both from your documentation, we may ask for more information or deny your request.

You can submit a Rent Forgiveness Request through the link we shared in your welcome email.

4. Your Responsibilities

To be eligible for rent forgiveness, you agree to:

  • Provide accurate and truthful information when you enroll in the program and any time you submit a Rent Forgiveness Request.

  • Submit your Rent Forgiveness Request and supporting documentation within the timelines described in your Lease Addendum.

  • Continue to pay any fees that are not part of base rent (for example, pet fees, washer and dryer rental, trash fees, or smart home fees).

  • Make a reasonable, ongoing effort to find a new job or replace lost income while your request is open.

  • Let us know ASAP if your circumstances change while your request is being reviewed or while you're receiving rent forgiveness.

What you're confirming when you submit a request

Each time you submit a Rent Forgiveness Request, you are confirming the following to DenZen and your Property Partner. These confirmations protect the program for every resident who relies on it.

  1. Accurate information at enrollment. The information you provided when you signed your lease and enrolled in the DenZen rent forgiveness program was accurate and complete to the best of your knowledge.

  2. No known reason to claim at enrollment. At the time you enrolled in the program, you were not aware of any fact, matter, or circumstance that could reasonably give rise to a Rent Forgiveness Request.

  3. Loss was not foreseeable. At the time you enrolled, you were not aware of any circumstances that made your job loss foreseeable, intended, or expected. For example, you had not been told a layoff was coming or you were not on a performance improvement plan.

If we determine that one or more of these representations is not accurate, your Rent Forgiveness Request may be denied, and your enrollment in the program may be reviewed. If a Rent Forgiveness Request is based on inaccurate information, fraud, or material misrepresentation, the request will be denied and there may be additional consequences under your lease. The complete list of exclusions is in your Lease Addendum.

5. Privacy & Communications

Your privacy matters. The full details of what information we collect, how we use it, and how we share it are described in our full Privacy Policy, available here and included in your welcome materials.

Other privacy policies that may apply

If you enrolled in DenZen through a partner or platform (for example, a property management portal or a third party that introduced you to the program), that partner may have its own privacy policy that also applies to information they collect about you and share with us. By enrolling, you consent to the processing of your personal data under our Privacy Policy and under any partner privacy policy disclosed to you at the time you enrolled.

Your consent to data processing

By enrolling in the DenZen rent forgiveness program and submitting a Rent Forgiveness Request, you consent to the collection, use, and processing of your personal data by DenZen in accordance with our Privacy Policy.

You also acknowledge that, to administer the program, DenZen may share information about your enrollment and certain details related to your Rent Forgiveness Request with your Property Partner. We share only the information needed to process your enrollment and your requests. Everything else remains protected under our Privacy Policy.

Electronic communications

By enrolling in DenZen, you agree to receive all notices, approvals, and other documents from us electronically, including by email at the address you provided at enrollment. If your email changes, please update us at [email protected] so you don't miss anything important about your enrollment or a Rent Forgiveness Request.

6. Changes to these terms

We may update these Terms and Conditions from time to time. If we make a material change, we'll let you know by email and post the updated version with a new effective date. Your continued enrollment after the new effective date means you accept the updated terms.

7. If we disagree

The following terms govern how any dispute between you and DenZen will be resolved.

Where our services take place

DenZen is headquartered in Colorado, and all services we provide under this program are deemed to take place in Colorado, regardless of where you live or where you submit your request.

Governing law

These Terms and Conditions are governed exclusively by the laws of the State of Colorado, without regard to any conflict of law rules.

Binding arbitration

Any claim or dispute between you and DenZen that arises out of or relates to the rent forgiveness program or these Terms and Conditions will be resolved through binding arbitration, not in court.

The arbitration will be administered by the American Arbitration Association (AAA) under the Federal Arbitration Act and the AAA's Consumer Arbitration Rules.

No class actions

Any disagreement between you and DenZen will be handled one on one, not as part of a group lawsuit.

YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION. THE ARBITRATOR CANNOT COMBINE MORE THAN ONE PERSON'S CLAIMS OR OVERSEE ANY FORM OF CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING.

Limits on damages

In any arbitration or other legal action between you and DenZen, neither party may recover indirect, special, incidental, consequential, or punitive damages. This includes damages for personal injury, pain and suffering, emotional distress, loss of profits, loss of business, or loss of anticipated savings, regardless of the basis for the claim or the legal theory behind it.

This limit also protects DenZen's affiliates, and each of their respective employees, agents, officers, and directors. None of them may be required to pay these kinds of damages to you in connection with the program or these Terms and Conditions.

8. Other legal terms

Waiver

If we don't enforce a particular term right away, that doesn't mean we've given up our right to enforce it later, or to enforce any other term.

Severability

If a court finds any part of these Terms and Conditions to be invalid or unenforceable, that part will be removed or limited as needed, and the remaining parts will stay in full force and effect.

Entire agreement

These Terms and Conditions, together with your Lease Addendum and our Privacy Policy, make up the complete agreement between you and DenZen regarding the rent forgiveness program.
